Public Offer Agreement for the Sale and Purchase of Goods

This document is an official public offer from the individual entrepreneur IE Taras Mykolayovych Hetmanchuk(hereinafter — "Seller") to conclude a sale and purchase agreement for goods presented in the GETMAN STORE online store on the website getmanstore.com.

By placing an order on the website, the Buyer confirms that they have read, understood, and agree to the terms of this Public Offer.

1. General Provisions

1.1. This Public Offer regulates relations between the Seller and an individual placing an order for goods through the GETMAN STORE online store (hereinafter — "Buyer").

1.2. The terms of this Offer apply to all goods presented on the website getmanstore.com, unless otherwise explicitly stated on the page of the respective product.

1.3. The Buyer's placement of an order through the website signifies acceptance of the terms of this Offer.

1.4. The Buyer confirms that at the time of placing the order, they possess the necessary legal capacity to conclude the agreement and make a purchase.

1.5. The Seller has the right to amend this Offer. The current version of the document is published on the GETMAN STORE website and applies to orders placed after its publication.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of the goods selected and ordered on the website to the Buyer, and the Buyer undertakes to accept and pay for such goods in accordance with the terms of this Offer.

2.2. The name, description, characteristics, available sizes and colors, price, and other information about the goods are indicated on the respective product page.

2.3. Product images on the website are intended to convey their appearance as accurately as possible. However, the color shade may vary slightly depending on the Buyer's device screen settings, lighting during photography, and other technical factors.

2.4. The availability of goods and available options is determined at the time of order placement and confirmation.

3. Order Placement

3.1. To place an order, the Buyer selects the goods, the required size, color, and other available parameters, adds the goods to the cart, and fills in the necessary information for placement and delivery.

3.2. The Buyer is responsible for the accuracy of the data provided during order placement, including name, phone number, email address, and delivery information.

3.3. After placing an order, the Buyer may receive an automatic confirmation via email, phone number, or other available means.

3.4. In case of unavailability of the ordered goods or other circumstances that prevent the order from being fulfilled, the Seller will contact the Buyer to agree on a replacement of the goods, a change in order terms, or its cancellation.

3.5. If the order was pre-paid but cannot be fulfilled by the Seller, the funds paid for the respective goods will be refunded to the Buyer in accordance with the procedure established by law and the payment system's rules.

4. Product Price and Payment

4.1. Product prices are indicated on the website in hryvnias (UAH).

4.2. The price indicated on the website at the time of order placement is current, except in cases of obvious technical error.

4.3. The following payment methods may be available to the Buyer:

  • online payment by bank card;

  • payment upon receipt, if this method is available for the respective order;

  • installment payment or another installment service, if such an option is available during order placement;

  • other payment methods specified on the website.

4.4. The specific list of available payment methods is displayed to the Buyer during order placement.

4.5. When using third-party payment services, payment processing may also be carried out in accordance with the rules of the respective bank or payment service.

5. Delivery

5.1. Orders are delivered by the carrier Nova Poshta or by another method, if available and specified on the website.

5.2. The estimated delivery time is 1–3 business days from the moment the order is handed over to the carrier and may depend on the recipient's locality, the carrier's operating schedule, and other circumstances.

5.3. The order processing and dispatch time may be specified separately on the website.

5.4. The delivery cost is determined in accordance with the terms specified on the website during order placement and/or the carrier's tariffs.

5.5. If free delivery applies for a certain order amount, the relevant condition is displayed on the website and applies in accordance with the current GETMAN STORE rules at the time of order placement.

5.6. After the shipment is handed over to the carrier, the Buyer may be provided with an express waybill number to track the delivery.

5.7. Upon receiving the order, the Buyer is recommended to check the integrity of the packaging, completeness, and condition of the goods.

6. Exchange and Return of Goods

6.1. The Buyer has the right to exchange or return goods of proper quality in cases and in the manner provided by the legislation of Ukraine.

6.2. For goods that, in accordance with the law, can be returned or exchanged, the Buyer may contact the Seller within 14 calendar days, excluding the day of purchase, provided that the legally established requirements are met.

6.3. For return or exchange, the goods must:

  • not have been used;

  • not show signs of wear, washing, damage, or contamination;

  • retain their marketable appearance and consumer properties;

  • have preserved labels, tags, and other complete set elements, if they were on the goods;

  • comply with other requirements stipulated by the legislation of Ukraine.

6.4. Returns and exchanges are carried out in accordance with the procedure specified on the "Delivery and Returns" page on the GETMAN STORE website.

6.5. In case of receiving goods with a manufacturing defect, incorrect goods, or an error on the part of the Seller, the Buyer must contact GETMAN STORE customer support to resolve the situation.

6.6. Refunds are made in the manner and within the timeframes provided by the legislation of Ukraine, taking into account the technical timeframes of banks and payment systems.

6.7. Restrictions on the return or exchange of certain categories of goods apply only in cases provided by current legislation of Ukraine.

7. Rights and Obligations of the Seller

7.1. The Seller undertakes to:

  • provide the Buyer with the necessary information about the goods and the terms of their purchase;

  • properly process the placed order;

  • transfer the goods to the Buyer in accordance with the confirmed order;

  • comply with the legislation of Ukraine regarding consumer protection and e-commerce.

7.2. The Seller has the right to:

  • change the assortment and prices of goods before the Buyer places an order;

  • conduct promotions, provide discounts, and establish special sales conditions;

  • cancel an order if it is impossible to fulfill it, with mandatory notification to the Buyer;

  • contact the Buyer to clarify information necessary for fulfilling the order.

8. Rights and Obligations of the Buyer

8.1. The Buyer undertakes to:

  • familiarize themselves with the information about the goods before placing an order;

  • provide accurate contact details and delivery information;

  • pay for the goods in accordance with the chosen payment method;

  • receive the order in the agreed manner;

  • comply with the terms of this Offer.

8.2. The Buyer has the right to receive information about their order and contact GETMAN STORE customer support regarding payment, delivery, exchange, and return issues.

9. Liability of the Parties

9.1. The parties are liable for non-fulfillment or improper fulfillment of their obligations in accordance with this Offer and the current legislation of Ukraine.

9.2. The Seller is not liable for delivery delays caused by the actions or inactions of the carrier, disruptions in its operation, force majeure circumstances, or other circumstances beyond the Seller's reasonable control.

9.3. The Seller is not liable for the impossibility of fulfilling an order caused by the Buyer providing incorrect or incomplete contact details or delivery information.

9.4. Nothing in this Offer limits the Buyer's rights guaranteed by the legislation of Ukraine.

10. Force Majeure

10.1. The parties are released from liability for non-fulfillment of obligations if it was a consequence of insurmountable force majeure circumstances that the parties could not foresee or prevent with reasonable measures.

10.2. Such circumstances may include, in particular, military actions, emergencies, natural disasters, widespread disruptions in the operation of transport, energy, or telecommunications infrastructure, and other force majeure circumstances in accordance with the legislation of Ukraine.

11. Personal Data

11.1. When placing an order, the Buyer provides personal data necessary for accepting, processing, paying for, and delivering the order, as well as for communication regarding its fulfillment.

11.2. The processing of personal data is carried out in accordance with the current legislation of Ukraine and the GETMAN STORE Privacy Policy, posted on the website.

11.3. Data may be transferred to third parties only to the extent necessary for fulfilling the order and ensuring the operation of the store, including delivery services, banks, and payment services, or in other cases provided by law.

12. Intellectual Property

12.1. Materials posted on the GETMAN STORE website, including photographs, graphic materials, design, texts, logos, and other elements, may be objects of intellectual property rights.

12.2. The use of such materials by third parties is carried out in accordance with the legislation of Ukraine and taking into account the rights of their legitimate owners.

13. Dispute Resolution

13.1. All disputes arising between the Seller and the Buyer are sought to be resolved by the parties through negotiations.

13.3. If a dispute cannot be resolved through negotiations, it is resolved in accordance with the current legislation of Ukraine.

14. Term and Amendment of the Offer Terms

14.1. This Offer comes into force from the moment it is posted on the GETMAN STORE website and remains valid until it is replaced by a new version or terminated.

14.2. The Seller has the right to update the terms of the Offer due to changes in legislation, payment methods, delivery, store operations, or for other reasonable reasons.

14.3. For a specific order, the version of the Offer effective at the time of its placement applies, unless otherwise provided by law.
